Patayan sa drug war at sa Davao noong mayor pa si Duterte pinaiimbistigahan ng ICC Prosecutor

Hiniling ni International Criminal Court Prosecutor Fatou Bensouda sa Pre-Trial Chamber ng korte na bigyan ng “judicial authorization” ang imbestigasyon ukol sa madugong drug war ng administrasyon ni Pangulong Rodrigo Duterte.

Ayon pa sa resulta ng imbestigasyon ng tanggapan ni Bensouda, “state actors, primarily members of the Philippine security forces, killed thousands of suspected drug users and other civilians during official law enforcement operations.”

“There is a reasonable basis to believe that the crime against humanity of murder has been committed in the Philippines between July 1, 2016 and March 16, 2019, the date the Philippines withdrew from the court. The suspected crimes happened in the context of the government of Philippines ‘war on drugs’ campaign,” wika ni Bensouda sa kanyang pahayag.

Matapos aniya ang masusing pagsusuri, naniniwala ang ICC Prosecutor na nagkaroon ng diumano’y pagmamalabis ang Philippine National Police sa kanilang mga operasyon na nagresulta sa pagkamatay ng mga biktima

“Following a thorough preliminary examination process, the available information indicates that members of the Philippine National Police, and others acting in concert with them, have unlawfully killed between several thousand and tens of thousands of civilians during that time,” dagdag pa ng Prosecutor.

Isinama rin sa pinaiimbestigahan ni Bensouda ang mga diumano’y patayang naganap sa Davao noong 2011 hanggang 2016 kung saan mayor at vice mayor pa si Duterte dahil sa pareho umanong “patterns of killing”.

Bunsod ng mga diumano’y paglabag sa batas sa pagpapatupad ng “war on drugs” inirekomenda ng ICC Prosecutor’s Office na magkaroon ng pre-trial sa kaso.

Ang Pre-Trial Chamber ay may kakayahang mag-isyu ng warrant of arrest laban sa mga nasasakdal kapag nakumpirmang may basehan nga ang ICC Prosecutor sa kanyang rekomendasyon.

Sa pre-trial stage din magkakaalaman kung may sapat na ebidensya upang magkaroon ng paglilitis.

Nauna rito, nanindigan noon pa man si Pangulong Duterte na binabalewala niya ang ikinaso sa kanya sa ICC, dahil wala umanong jurisdiction o kapangyarihan sa kanya ang korte. Marso 2018 ng inanunsyo ng Pangulo ang pagtiwalag ng Pilipinas sa ICC– bagay na pormal na naisakatuparan noong 2019.

Pero ayon kay Prosecutor Bensouda, mayroon pa ring jurisdiction ang ICC sa Pilipinas dahil 2016 nang magsimula ang “drug war”, ito ang panahon na kasapi pa rin sa ICC ang bansa.

“The Court retains jurisdiction over crimes that are alleged to have occurred on the territory of that State during the period when it was a State Party to the Rome Statute. Moreover, these crimes are not subject to any statute of limitation” paliwanag pa ni Bensouda.

Ngayong araw, June 15, 2021, nakatakda namang magretiro si Prosecutor Bensouda sa ICC. Siyam na taon din siyang umupo bilang prosecutor. Papalitan siya ni Karim Khan, isang international human rights lawyer na pormal na uupo bilang Prosecutor ng ICC bukas.
